Donald Trump: 20 US States Sue President Over $100k H-1B Visa Fee, Will There Be Respite For Indians?

US President Donald J Trump has been sued by 2 states over his for the "unlawful" introduction of a $100,000 visa fee for H-1B visa applications.

What do States Have To Say Against H-1B Visa Fee By Donald Trump?

Filed by the Democratic Party’s Attorneys-General in these states, the lawsuits argue that Trump doesn’t have the legal authority to rewrite immigration law without constitutional approval.

The states argue that H-1B visas are required for the US states to hire skilled workers like nurses, university faculty, physicians and researchers.

Attorney-General Dan Rayfield remarked the colleges, research institutions and universities of Oregon rely on skilled international workers to keep courses on track, labs running and innovation moving forward. The enormous fee levied by Donald Trump would make it almost impossible for them to hire the required experts, threatening the ability of Oregon to educate, grow and compete.

California Attorney-General Rob Bonta said no US President can ignore the co-equal branch of government of Congress, ignore the law or the Constitution.

It was also argued by the states that the US Trump administration far exceeded the fee-setting authority granted by the US Congress for raising the visa fee cost to $100,000 from earlier cost levels that ranged from approximately between $960 to $,7595 in fees.

The US Chamber of Commerce said Donald Trump has obviously considerable authority over the entry of non-citizens into the country but that authority is legally bounded by statue and, therefore, cannot directly contradict laws that have been passed by Congress.
