The Supreme Court has come down heavily on the hate speech case. The Supreme Court said that hate speech is like a poison which is harming the social fabric of India. The debate on the channels has become unbridled. Political parties are also seeing benefits in this at the cost of social harmony. Political parties will come and go. The Supreme Court said that strict action should be taken against the culprits. The Supreme Court asked the central government whether it intended to enact a law or not as the existing system was inadequate to deal with such cases. A bench of Justices M Joseph and Hrishikesh Roy said the Center should not be a ‘silent spectator’. This should lead to a solution to the problem.
The Supreme Court on Wednesday said in the hate speech case that why the central government is standing as a mute spectator in this matter. The Supreme Court said in an oral remark that where is our country going. During the last hearing, the Election Commission had said that there is no clear law in the country related to hate speech, so the Supreme Court should pass an order in this matter.
The Supreme Court said that hate speech is coming either through main stream TV or through social media. At least the anchor’s role is important in the main stream media. As soon as someone tries to give hate speech, it is the duty of the anchor to stop it immediately. Justice Joseph said that we should have a proper legal framework. A total of 11 applications are before the bench of Justice KM Joseph and Justice Rishikesh Rai, seeking directions to regulate the hate speech case.
Referring to the role of TV anchors, the Supreme Court said that it is their responsibility to stop hate speech while discussing an issue. The bench refused to include the Press Council of India and the National Association of Broadcasters (NBA) as parties in the petitions spreading hate speech and rumours. Petitioner lawyer Ashwini Kumar Upadhyay had sought to make the Press Council of India and the National Association of Broadcasters parties in the case.
