No stay on Rahul Gandhi conviction: Gujarat HC

The Gujarat High Court on Tuesday refused to grant interim relief to Congress leader Rahul Gandhi in the Modi surname case. The court has reserved its decision on his plea to stay the sentence in the 2019 case. Justice Hemant Prachhak will pronounce the verdict after the vacation. Till then the court refused to give any interim relief to Rahul Gandhi.

Rahul Gandhi has filed a petition in the High Court seeking a stay on conviction in a criminal defamation case following his remarks related to the 'Modi surname'. In the case, Rahul Gandhi was sentenced to two years in jail by a court in Surat. After this decision, Rahul had to lose his membership of the Lok Sabha as well.

Hearing was held on 29 April

Earlier, a hearing was held on April 29 in the Gujarat High Court on Congress leader Rahul Gandhi's petition challenging the decision of the Surat sessions court. During this, the court had asked senior advocate Abhishek Manu Singhvi, representing Rahul Gandhi, to file a reply by May 2. After this, the next hearing was fixed on Tuesday, May 2.

Rahul Gandhi's counsel Abhishek Manu Singhvi argued in the court that the alleged offense for which Congress leader Rahul Gandhi has been convicted and sentenced to two years in prison is neither serious nor this includes ethical misconduct.

Surat court refused to ban

Earlier, a Surat court had refused to stay his conviction in a criminal defamation case related to his remarks related to the Modi surname. After this, Rahul had approached the Gujarat High Court. After a judge recused himself in the case, the case was now being heard by a new judge.
