Vice President defends his response to Sonia Gandhi’s judiciary remark

The opposition Congress is fighting hammer and tongs to have the chair’s remarks regarding UPA Chairperson Sonia Gandhi’s “delegitimize judiciary” remark removed. Rajya Sabha Chairman Jagdeep Dhankar responded by defending his behaviour and claiming that, had he not reacted, he would have violated his oath and failed to fulfil his constitutional duty.

The issue was brought up by senior Congressman Pramod Tiwari in the Rajya Sabha, and his senior colleague and opposition leader Mallikarjun Kharge joined the discussion. They both stated that if a member of the Loksabha (Sonia Gandhi) brings up a matter, it should never be discussed in the Parliament and that the remarks made by the house speaker should be withdrawn and expunged from the records because they set a poor example.

Piyush Goyal, a Union Minister and the House’s leader, joined the discussion and claimed that the Vice President of India, a person chosen by both houses of Parliament, and the House’s high constitutional authority, had been disparaged.

Amid the din the house, many other members made remarks on the issue

To this Rajya Sabha Chairman Dhankar clarfied, “The comments related to what I said from this chair on December 8 were made. The observations were made to that great degree because the vice president and chairman of the Rajya Sabha might be used by the ruling party to undermine the judiciary.” He claimed that if he had not replied, it would have had “demeaning consequences” and that it was intended to give the idea that the chair would join the administration in a pernicious and nefarious scheme to delegitimize the judiciary.

“Demonization of the court is equivalent to the end of democracy. This partisan conflict must be resolved inside “added Mr. Dhankar.

“I can assure the members that I engaged in huge research with everyone who knows the matter, communicated with prior secretaries general, and then concluded that I will be abjuring my oath and getting out of my constitutional duties if I do not reply,” the Rajya Sabha Chairman continued. On December 22, Mr. Dhankhar called Mrs. Gandhi’s comments that the government is trying to ‘deligitimise the judiciary’ ‘wrong’ and asked political leaders not to submit important constitutional positions to partisan positions.

Further, he had stated that Mrs. Gandhi’s statement was far off from his observations because he had no intention of delegitimizing the courts.

On December 21, Sonia Gandhi accused the Government of making a calculated attempt to ‘delegitimize judiciary’ and described it as a troubling new development.

She also claimed that the government was attempting to lower the judiciary’s standing in the eyes of the general public. Further she had stated that judiciary has been criticized in speeches by ministers and even a high constitutional authority for a variety of reasons.
