SC: Life convicts for over 10 years should get bail if awaiting decision on appeals

The Supreme Court on Thursday said that the convicts who have completed 10 years of life imprisonment and whose appeal is not likely to be heard in the High Court in the near future, should be released on bail, provided relief No solid reason exists for refusal.

The court said that to fulfill the objective of decongesting the jails, it should be done for those convicts whose appeal against their conviction is pending for years and there is no possibility of hearing it in the High Court in the near future.

A bench of Justice Sanjay Kishan Kaul and Justice Abhay S Oka was hearing the bail applications of the convicts who were sentenced to life imprisonment. The appellants have sought bail on the ground that their appeals are pending in different High Courts for years and they are not likely to be heard in the near future, as a large number of pending cases are obstructing the judicial process. The court said, ‘We are of the view that those convicts who have completed 10 years of their sentence should be released on bail, whose appeal is not likely to be heard in the near future.’

Justice Gaurav Aggarwal said that under the earlier order of the Supreme Court, 6 High Courts were asked to give details and they have filed an affidavit. He said, the figures of the High Court show that there are 5740 cases where appeals are pending whether it is at the level of single bench or at the level of division.
