Supreme Court Rejects Opposition Parties' Request to Curb Misuse of CBI and ED

Supreme Court: On Wednesday, the Supreme Court turned down a request by 14 opposition parties, including the Congress, who claimed that the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) had been deployed arbitrarily to target political rivals. Once the Supreme Court declined to hear their appeal, the opposition parties abandoned their case. DY Chandrachud, the Chief Justice of India, and Justices PS Narasimha and JB Pardiwala ruled that politicians do not have any special immunity.

The court ruled that without knowing the specifics of each instance, it was impossible to establish broad rules. The Supreme Court stated that "politicians cannot have their own rules." "Thus, after collecting millions of dollars from regular pensioners without making a payment, several FIRs are filed, and here is where the case ends up. Can we say that no arrests are possible in this situation? How can we claim that there can be no arrests unless a three pronged test is satisfied if we acknowledge that political leaders are totally on equal footing with normal citizens and have no higher immunity? "asked the highest court.

121 political figures under investigation by ED

Senior attorney Abhishek Singhvi stated during the hearing that the number of CBI and ED cases increased by 600% between 2013–14 and 2021–22. He claimed that of the 121 political figures under investigation by ED, 95% were affiliated with the opposition parties. Almost 95% of the 124 probes the CBI has opened are related to opposition parties, according to Singhvi. Singhvi told the Supreme Court that "this has a chilling impact on the credibility of political opposition." The SC claimed that the petitioners were attempting to use statistical extrapolation to persuade the court to set rules. "You're attempting to extrapolate the stats into dependable legal principles. Thus, these statistics are now limited to politicians, "explained CJI Chandrachud. The DMK, RJD, BRS, Trinamool Congress, AAP, NCP, Shiv Sena (UBT), JMM, JD(U), CPI(M), CPI, Samajwadi Party, and the J&K National Conference are among the parties that have signed the united petition in addition to the Congress.
