The Supreme Court on Tuesday transferred the petitions challenging the Agnipath military recruitment scheme – to the Delhi High Court. The top court said it felt “desirable and proper” to have the view of the Delhi HC, which is already hearing petitions on the scheme.
The top court has further ordered that any similar petitions that are currently challenging the scheme in the high courts of Kerala, Patna, Punjab, Haryana, and Uttarakhand may be filed as intervention applications before the Delhi High Court, or the petitioners may request that their arguments be transferred to Delhi.
The Supreme Court further ruled that identical procedure will be followed in any future high court petitions filed about the plan.
“In our judgement, multiplicity of writ petitions on the topic will not be desirable or proper,” the three-judge panel of Dhananjaya Y. Chandrachud, Surya Kant, and AS Bopanna stated. The court also explored the option of bringing all petitions to the Supreme Court but said, “Adopting such a course would deprive us of the view of the high courts.”

The petitioners said that the matter includes a problem that affects all of India and that the Supreme Court should take it into consideration. However, the bench said that just because a problem is “pan-Indian,” that doesn’t mean that it shouldn’t be heard by many high courts. The court was considering three PILs submitted by Ravindra Singh Shekhawat, ML Sharma, and Harsh Ajay Singh.
The Supreme Court ordered the Center to provide a copy of its order to the Registrar (Judicial) of all high courts with ongoing cases of a similar nature so that the Chief Justices of those high courts may issue the orders required by the SC ruling.
