Activist Gautam Navlakha Released From Jail

More than a week after the Supreme Court's order, Bhima Koregaon case accused Gautam Navlakha was released from Taloja Jail. He will now be kept under house arrest at a community hall in Navi Mumbai owned by the Communist Party of India (Marxist). Navlakha's release came a day after the top court dismissed a plea by the National Investigation Agency (NIA) to set aside its November 10 order allowing house arrest and directed its order to be given effect to within 24 hours.

Meanwhile, a special court in Mumbai hearing cases related to the National Investigation Agency issued a release memo to facilitate Navlakha's month-long detention, news agency PTI reported. The probe agency today submitted the compliance report to the special court regarding completion of formalities for the release of the activist. After which the court has issued the release memo.

The top court had allowed Navlakha to be put under house arrest due to his deteriorating health. The court also imposed certain conditions, including a ban on the use of CCTV surveillance phones and no access to the internet. The court has allowed Navlakha's partner Sahba Hussain to live with him instead of his sister.

The NIA objected to the house arrest citing security concerns at the selected premises. Solicitor General Tushar Mehta and Additional Solicitor General SV Raju, appearing for the NIA, told the court that the building belonged to the Communist Party and was not a flat but part of a public library.

Navlakha is facing UAPA charges in the Bhima Koregaon violence case. The case pertains to alleged inflammatory speeches delivered at the Elgar Parishad conference held in Pune on 31 December 2017. The police claim that these speeches incited violence the next day near the Koregaon-Bhima war memorial. The Pune police had claimed that the conclave was organized by people linked to the Maoists. The NIA later took over the investigation.
