Anil Deshmukh Case Former Maharashtra minister to remain behind bars; Special court denies bail

Anil Deshmukh: Anil Deshmukh, a former home minister of Maharashtra, and Sanjeev Palande, his personal secretary, had applied for bail, but it was denied by a special CBI court in Mumbai.

Deshmukh is presently receiving treatment in a local hospital for his cardiac issues. The accused is receiving sufficient medical care that meets his needs, according to the court’s observation. The court observed that substantial sums of money were at stake in the Deshmukh case, which has an impact on the nation’s financial stability.

The statement of the approver, former Mumbai police officer Sachin Waze, and others recorded under section 164 by the Magistrate, according to Special Judge SH Gwalani “plays a very important role. Therefore, these statements cannot be overlooked, and the facts disclosed by the matters cannot be ignored at the stage of hearing.”

The Judge further said, “Question of admissibility of such evidence would be a matter of trial. Its sufficiency or insufficiency cannot be answered at the stage of bail. At the stage of bail, a detailed examination of evidence on the merits of the case need not be undertaken.”

The court stated in its ruling that “When a person is committing a murder, it may be on the spur of the moment, but this is an economic crime which can happen with calculation, he is aware.” Deshmukh was taken into prison for an inquiry by the CBI in April 2022 after the CBI had launched the case against him in April of the previous year. The ED had detained Deshmukh in November of the previous year. The Bombay High Court recently granted bail to Deshmukh.
