Article 370 Verdict: After acceding to India, the Supreme Court declared that Jammu and Kashmir no longer possesses internal sovereignty in its ruling on Article 370. “We hold it does not hold any internal sovereignty after accession to the Union of India,” said Chief Justice DY Chandrachud. On Monday, the Supreme Court declared that Article 370, which gave Jammu and Kashmir special status, is only a provision for the time being. It was decided that even after the Jammu and Kashmir Constituent Assembly was dissolved, the President could still declare that Article 370 was no longer in effect. The five-judge Constitution Bench of the Supreme Court rendered a decision on the legality of Article 370 and upheld the President’s 2019 decree eliminating Jammu and Kashmir’s special status.

Center’s Decision in Focus

A five-judge Constitution bench led by Chief Justice of India DY Chandrachud determine the constitutionality of the Center’s August 5, 2019, decision to repeal Article 370 of the Constitution, which granted the former state of Jammu and Kashmir special status.

Marathon Hearings Unveiled

The Supreme Court began its 16-day, all-day hearings in August, and on September 5 it reserved its decision. Omar Abdullah, the leader of the National Conference (NC), declared a day before the Supreme Court’s decision that his party would not disrupt the calm in Jammu and Kashmir, even in the event of a negative decision. He went on to say that his party would keep up its efforts to restore the rights of the local populace through nonviolent means as specified by the Constitution.

Supreme Court Verdict Awaited

“The Supreme Court has to give its verdict, let it. If we had to disturb the situation, we would have done it after 2019. However, we said it then, and we reiterate it now, that our fight will be peaceful and in accordance with the Constitution, taking help of the law to protect our rights and preserve our identity,” said Abdullah.

Amit Raina’s Confidence

Amit Raina of the NGO Roots in Kashmir has expressed his confidence that the Court will not bring back this Article, while Sunil Dimple, the leader of the Jammu and Kashmir People’s Conference, has stated that the decision that will come today will be written in golden letters. These statements come as the nation awaits the historic ruling on Article 370 by the Supreme Court.
