Azam Khan Remains Disqualified As MLA After Court Setback

A local court in Uttar Pradesh on Thursday dismissed Azam Khan, the head of the Samajwadi Party, in his appeal against a conviction in a case involving hate speech that resulted in his exclusion from office as an MLA.

Following a directive from the Supreme Court for the lower court to hear and decide on the appeal by Thursday, Mr. Khan filed an appeal before the Rampur district and sessions court yesterday, asking for his conviction to be set aside.

In the 2019 case involving hate speech, the Rampur court had sentenced Mr. Khan to three years in prison on October 27.

As a result of his conviction, he was stripped of his right to serve in the Uttar Pradesh Assembly in accordance with the Representation of the People Act.

His seat in Rampur Sadar was subsequently declared vacant by the Assembly secretariat.

The Rampur Sadar by-election, along with a few other assembly seats and the Mainpuri Lok Sabha seats, will take place on December 5 according to the Election Commission’s announcement.

The Poll Commission was ordered not to release the election notification for the Rampur Sadar seat till November 10 by the Supreme Court during the day.
