Centre approaches SC seeking review of judgement granting Delhi government power over services

Centre approaches SC: The Centre approached the Supreme Court on Saturday seeking review of its May 11 verdict that granted National Capital Territory of Delhi the legislative and executive power over services in the national capital. This comes a day after Centre on Friday promulgated GNCTD Amendment Ordinance, 2023 restoring to itself the power over “services”. The ordinance makes the Lieutenant Governor the final arbiter in the matters concerning transfer posting, vigilance, and other incidental matters.

‘LG decision shall be final’

The body will comprise the Delhi Chief Minister, Chief Secretary, and Home Secretary of the Delhi government. “Provided also that in case of difference of opinion, the decision of the Lieutenant Governor shall be final,” the order read.

“In view of its special status as a national capital, a scheme of administration has to be formulated by law, to balance both local and national democratic interests which are at stake, which would reflect the aspirations of the people through joint and collective responsibility of both the Government of India and the Government of National Capital Territory of Delhi (GNCTD),” the government order read.

Recommendations to LG

“A permanent authority headed by the Delhi chief minister is being introduced to make recommendations to the Lieutenant Governor regarding matters concerning transfer posting, vigilance and other incidental matters,” it further said.

On May 11, five-judge bench of CJI DY Chandrachud, Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha granted power to NCTD. The bench unanimously ruled that L-G is bound by aid and advice of the NCT government except the matters relating to land, public order & police and it is ideal to hold that a democratically elected government shall have control over its officers.
