Consensual sex that doesn’t culminate in marriages can’t be termed as rape, rules Karnataka HC

Karnataka: According to the Karnataka High Court, just because a five-year consenting sexual relationship did not end in marriage does not make it rape. The court made this statement while hearing the case of a guy who had been charged with rape by his five-year ex-girlfriend.

Karnataka High Court Upholds Consensual Sexual Relationship

The complainant and the accused had multiple sexual encounters over a five-year period, according to Justice M. Nagaprasanna, who also remarked that they were deeply in love. The judge added that there was “no force as alleged while sustaining the physical connections” and that the relationship was consensual.

Court Dismisses Rape Charges Against Accused

“The consent in the current case is for several years—exactly five years—as is described in the complaint because the two were in love, not once, twice, or three times; not for days or months. Hence, it cannot be claimed that a woman’s consent was obtained for having such incidents over the course of five long years against her will “The bench ruled against the rape accusations. The accused claims that he and the complainant were initially friends before their friendship turned into a romantic one. Although having been physically intimate for five years, they were unable to be married due to disparities in caste.
