Delhi High Court Denies Arvind Kejriwal Temporary Relief in ED Case, What Next?

The Delhi High Court upholds its position that the Enforcement Directorate should have a chance to refute Arvind Kejriwal's claims by denying him temporary relief in the Enforcement Directorate case.

Arvind Kejriwal was denied any temporary relief by the Delhi High Court on Wednesday. The court reasoned that it would be unjust to deny the Enforcement Directorate (ED) a chance to refute the arguments put forth by the Delhi Chief Minister.

Upholding Fair Trial Principles

According to Justice Swarna Kanta Sharma’s bench, denying the ED the chance to file a reply would be tantamount to denying them a fair trial and going against a fundamental tenet of natural justice. The ED must be given this opportunity in order to have an effective representation.

The Delhi High Court was set to consider a petition filed by Arvind Kejriwal, currently imprisoned chief minister of Delhi, contesting his ED arrest in a money-laundering case related to the excise policy fraud. Arvind Kejriwal, the chief minister of Delhi, will appear before the Delhi High Court on Wednesday to contest his ED arrest in a money-laundering case involving the purported excise policy  scam.

Petitioning to Overturn Actions

Extra Solicitor General (ASG) S V Raju requested more time to submit a thorough response to the Chief Minister’s plea while the Delhi High Court considers Kejriwal’s appeal. According to Advocate Raju, they only received a copy of the plea yesterday.

Kejriwal has already petitioned the court to revoke and set aside all of the actions taken against him, including the issuance of summonses. The AAP and its supporters attempted to march towards the prime minister’s house on Tuesday in response to Arvind Kejriwal’s arrest, but were halted. Meanwhile, the BJP staged counter-protests calling for the resignation of the chief minister of Delhi.

INDIA Representatives Rally for Democracy

In response to Delhi Chief Minister Arvind Kejriwal’s detention, representatives of the opposition Indian National Developmental Inclusive Alliance (INDIA) would attend the march at Ramlila Maidan on March 31 to safeguard democracy, according to AAP Delhi convener Gopal Rai on Wednesday. “From March 28, 2,600 teams will go door-to-door inviting people to come to Ramlila Maidan. At the same time, AAP ministers and MLAs have been made observers, who will go to the assemblies and review preparations for the rally,” he said
