The Supreme Court on Friday dismissed the petition filed by the National Investigation Agency (NIA) against the bail granted to activist Anand Teltumbde. This petition was filed in the Bhima Koregaon case.
A bench of Chief Justice DY Chandrachud and Justice Hima Kohli said that it would not interfere in any way with the bail granted to Anand Teltumbde by the Bombay High Court in this matter. The High Court had granted bail to Anand Teltumbde on 18 November.
While granting bail to Anand Teltumbde, the Division Bench of Justice AS Gadkari and Justice Milind Jadhav of the High Court had said that there was no evidence against Anand of his involvement in terrorist activities. The charge sheet filed against Anand Teltumbde alleged that he had conspired to promote the ideology of the banned organization CPI Maoist and overthrow the government.
During the hearing, senior advocate Kapil Sibal, appearing for Anand Teltumbde, told the court that no documents have been recovered from his client. Sibal said that his client Yelgar was not even in the Parishad's programme. Anand Teltumbde, 73, has been a professor at IIT. He was arrested on 14 April 2020.
What is the whole matter?
Thousands of people from the Dalit community gathered at Bhima Koregaon near Pune in Maharashtra on January 1, 2018. They had gathered at this place two hundred years ago to celebrate the annual victory of the Mahar contingent of the English army against the Peshwas. A meeting called 'Yelgar Parishad' was organized at Shaniwar Pada one evening earlier. Many people gave speeches and sang songs in that meeting.
After this the people participating in the Bhima Koregaon event were attacked. One person lost his life and many people were injured. The two local and influential Hindutva leaders accused of inciting the mob to commit the violence were Sambhaji Bhide and Milind Ekbote. A police complaint was also lodged in his name. But no action has been taken on them till date.
On January 6, 2018, five human rights activists, Surendra Gadling, Rona Wilson, Sudhir Dhawale, Shoma Sen and Mahesh Raut were arrested from different parts of the country. He was accused of making an inflammatory speech at Bhima Koregaon on January 1, 2018 and tried under UAPA.
What are the allegations against Anand Teltumbde?
The police charge against Anand Teltumbde is that he is the top intellectual of the Maoists, he was the brain behind the Yelgar Parishad, and he was conspiring with his brother Milind Teltumbde, a senior leader of the Maoist party. It is alleged that the Maoist party used to pay him money and send him to seminars in foreign countries, from where he used to bring dangerous study material and give it to the Maoists.
The police had accused Anand of being involved in terrorist activities. The most stringent sections of the most stringent anti-terror law UAPA were used against him.
