Supreme Court to review it’s money laundering verdict

The Supreme Court has agreed to hear a review petition against the decision to uphold various provisions of the Prevention of Money Laundering Act (PMLA). The petition is to be heard in the Supreme Court on Thursday. On 27th of last month, the Supreme Court, while delivering its verdict on petitions challenging the powers of the Enforcement Directorate and the Prevention of Money Laundering Act, said that the ED has the right to arrest.

The court will hear the review petition of Congress MP Karti Chidambaram. A bench of CJI NV Raman, Justice JK Maheshwari and Justice CT Ravikumar agreed to hear the matter. Karti had filed a petition in the Supreme Court seeking reconsideration of the July 27 decision upholding the powers of the ED.

Earlier, the Supreme Court had given a big decision on PMLA. In a setback to the people trapped in the case registered by the Enforcement Directorate, the court had dismissed the petitions challenging various provisions of the PMLA Act. The court had said that the amendments made in the law in 2018 are correct. Along with this, the top court had upheld all the powers of the Enforcement Directorate (ED).

The Supreme Court had upheld all the powers given to the ED in the PMLA Act, including arrest, raid, summons, statement. The court had said that the Enforcement Case Information Report (ECIR) cannot be clubbed with the FIR. It is not necessary to give the copy of ECIR to the accused. It is enough to disclose the reasons during the arrest. The court had said that the statement given before the ED is the only evidence.

More than 100 petitions were filed in the Supreme Court challenging the constitutionality of several provisions of the PMLA. In this, the powers of the ED, the right to arrest, the manner of summoning witnesses and confiscation of property and the bail process were challenged. The petitions were filed by Congress leader Karti Chidambaram, NCP leader Anil Deshmukh and others.

Apart from this, the court decided to send the question of making changes in the Prevention of Money Laundering Act under the money bill before a 7-judge bench. In the petitions filed, an appeal was made by the ED to raid, arrest officer, confiscate the property and consider the difficult conditions of bail.
