Surrogacy Maternity Leave Rule:: In a significant move, the Central government has announced new maternity and paternity leave benefits for parents involved in surrogacy and adoption. These changes aim to support central government employees who become parents through these methods.
180 Days of Maternity Leave for Surrogates and Commissioning Mothers
The government has amended the Central Civil Services (Leave) Rules, 1972, to extend 180 days of maternity leave to surrogate mothers who are central government employees. This benefit ensures that surrogates receive adequate time for recovery and bonding with the newborn.
Additionally, the commissioning mother, who has less than two living children and is a central government employee, will also be entitled to 180 days of maternity leave. This provision recognizes the needs of commissioning mothers who may have undergone significant physical and emotional stress throughout the surrogacy process.
Child Care Leave for Commissioning Mothers
The amendments further benefit commissioning mothers with less than two living children by making them eligible for child care leave. This policy aims to provide these mothers with the necessary time to nurture and care for their newly born or adopted children.
Paternity Leave for Commissioning Fathers
In a progressive step, the government has also introduced paternity leave for commissioning fathers involved in surrogacy. Central government employees who are commissioning fathers with less than two living children will be entitled to 15 days of paternity leave. This leave can be taken within six months of the child's birth, allowing fathers to support their partners and bond with their new child during the crucial early months.
These changes reflect the government's commitment to supporting diverse family structures and recognizing the importance of parental leave in promoting family well-being and child development.
