FIR Filed Under Bharatiya Nyaya Sanhita
On Sunday, the police filed an FIR invoking serious provisions of the Bharatiya Nyaya Sanhita against Lotus Greens Construction Pvt Ltd and MZ Wiztown Planners Pvt Ltd. The sections include Section 105 (culpable homicide), Section 106 (causing death by negligence), and Section 125 (an act endangering life).

The charges relate to alleged negligence at the project site. This is suspected to have triggered widespread outrage and calls for accountability.
Developers Offer Conflicting Defences
Soon after the FIR was registered, the two firms named in the case presented differing versions of events. A spokesperson for Lotus Greens Construction Pvt Ltd stated that the company had “no role to play in the incident,” claiming that the plot in question had been transferred during the 2019–20 period.
On the other hand, Abhay Kumar of MZ Wiztown Planners denied direct responsibility. He asserted that the land was already excavated when it came under his firm’s control and that no official permission had been granted to commence construction work.
Abhay Kumar Claims Minority Stake, Cites Prior Complaints
Kumar described himself as a minority director. He is alleging that the majority shareholding was controlled by a lender associated with Lotus Greens. He also pointed to multiple court cases related to the land parcel, suggesting the matter was legally complex.
Calling the incident “an unfortunate accident,” Kumar said he had earlier alerted authorities about broken drainage lines and waterlogging issues in the area.
Investigation Ongoing
Police officials have said the investigation is ongoing and further action will be taken based on evidence and technical reports. Authorities are also examining regulatory approvals, site conditions, and responsibility among stakeholders.
