Online Games: In order to impose a 28 percent tax on the full face value of wagers placed in online gambling, casinos, and horse racing clubs, the Parliament passed revisions to the Central and Integrated GST rules on Friday. Additionally, offshore e-gaming companies operating in India will need to register under the Central GST (Amendment) Bill of 2023 and the Integrated GST (Amendment) Bill of 2023, both of which are being led by Finance Minister Nirmala Sitharaman. In the event that offshore platforms do not adhere to the requirements for GST registration and tax payment, it also provides for restricting access.

Which online games will get affected?

Online gaming that involves the payment or deposit of money, including virtual digital assets (VDAs), in the hopes of winning cash or VDAs is referred to as "online money gaming." This can refer to any game, scheme, competition, or other activity, regardless of whether the outcome or performance is determined by skill, chance, or both. Horse racing, casinos, and online gambling for real money will all be recognised as actionable claims under the revised GST law, just like lotteries, wagering, and gambling.

Council agreed to apply a 28 percent GST

The IGST Act was amended to include a clause imposing GST responsibility on online gambling services offered by foreign organisations. Such organisations would have to register for GST in India. The Council agreed to apply a 28 percent GST on the full face value of wagers placed in online gambling, casinos, and horse racing at its meeting on July 11. Three states namely Delhi, Goa and Sikkim voiced opposition, but the Council ultimately opted to impose GST at the face value on low-stakes wagers made in gaming platforms and casinos on August 2.
