Abhishek Manu Singhvi: In a significant legal move, Congress leader Abhishek Manu Singhvi has filed a petition in the Himachal Pradesh High Court challenging the rule of ‘Draw of Lots’ in Rajya Sabha elections. Singhvi’s petition questions the rationale behind the ‘Draw of Lots’ determining the outcome of the election, stating that it defies common sense for the name picked out to automatically become the loser.

Singhvi argued, “It is defying common sense that the name picked out in the ‘Draw of Lots’ becomes the loser.” He pointed out that nowhere in Section 65, which governs the ‘Draw of Lots’ rule, does it mandate that the name selected should be deemed the loser. According to him, this interpretation of the rule is intended only when there are three or more candidates, and the aim is to exclude one or two of them from the electoral process.
