‘All Conversion Cannot Be Illegal’: SC

The Supreme Court on Tuesday, while agreeing to hear a case of conversion law, said that not every conversion can be called an illegal conversion. The court has agreed to hear a petition by the Madhya Pradesh government, challenging the High Court’s decision to bar prosecution of inter-faith couples who marry without informing the District Magistrate.

The Supreme Court has said that every kind of conversion cannot be called illegal. Justice M.R. Shah and Justice C.T. Ravi Kumar’s bench has issued a notice in the case and adjourned the hearing of the case to February 7. Solicitor General Tushar Mehta had sought a stay on the High Court order, but the Supreme Court has refused to pass any direction. Mehta said that marriage is used for illegal conversion. We cannot turn a blind eye to this, but have refused to give any orders as of now.

The High Court, in an interim order, directed the state government not to prosecute youths who marry of their own free will under Section 10 of the MP Religious Freedom Act. The High Court had said on November 14 that Section 10, which makes it mandatory for a citizen wishing to convert, to give a (prior) declaration in this regard to the District Magistrate. In our opinion, the aforesaid decisions of this Court are unconstitutional in retrospect.”

The MP Religious Freedom Act prohibits conversion through misrepresentation, inducement, threat of use of force, undue influence, coercion, marriage or any other fraud. The petitioners had sought interim relief restraining the state from prosecuting anyone under the law. The court had given three weeks time to the state government to file its sequential reply to the petitions and said that the petitioners can file reply within 21 days thereafter.
