SC quashes Manish Sisodia's plea, suggests him to move trial court or Delhi HC

Manish Sisodia: The Supreme Court on Tuesday refused to intervene in the Delhi deputy chief minister Manish Sisodia arrest case. Manish Sisodia had moved to Supreme Court challenging his arrest by the Central Bureau of Investigation. The Apex Court suggested the Delhi deputy chief minister to either move to a trial court or the Delhi HC.

Supreme Court refuses Manish Sisodia's plea

The Supreme Court has refused to entertain Manish Sisodia's petition for quashing of the FIR or in the alternative, grant him bail from CBI custody. The SC suggested he must follow the procedure and approach either a trial court or the Delhi HC for the reliefs he is seeking from the SC. After this, the Delhi DY CM has withdrawn his petition.

The Chief Justice said our doors are open, but not to entertain everything. He said that it will be a bad precedent and just because it’s happening in Delhi. 

“We don't want to interfere in such a matter at the first instance. You can make all your points before the high court", the court said.

The court later said," The question is not about this court not having the power. We undoubtedly have the power but the question is whether we should exercise this extraordinary power in a given case. It will set a very wrong precedent. Just because an incident occurs in Delhi, we can't entertain it here directly."

Manish Sisodia to approach trial court

Abhishek Sanghvi, who appeared for Manish Sisodia, said, “we are going to the trial court for relief.”  "Can you arrest someone just because of non-cooperation?" asked Manish Sisodia. "I hold important portfolios, I am not a flight risk," he added.
