Rajasthan News: The Supreme Court has affirmed Rajasthan's two-child norm for government jobs, rejecting the challenge against the state's policy. The court stated that this rule falls within the ambit of policy, and there is no need for interference. It emphasized that denying government jobs to individuals with more than two children is not discriminatory and aligns with the objective of promoting family planning.
Supreme Court Upholds Rajasthan's Two-Child Policy for Government Jobs
This decision aligns with the Supreme Court's earlier stance when a similar rule for panchayat elections was upheld. The bench of Justice Suryakant, Justice Deepak Datta, and Justice KV Vishwanathan maintained the Rajasthan High Court's October 12, 2022 judgment, dismissing the plea of ex-serviceman Ramji Lal Jat.
Ramji Lal Jat applied for the position of Rajasthan Police Constable on May 25, 2018
In January 2017, after retiring from defense services, Ramji Lal Jat applied for the position of Rajasthan Police Constable on May 25, 2018. However, his candidacy was rejected under Rule 24(4) of the Rajasthan Police Subordinate Service Rules, 1989, as he had more than two children post-June 1, 2002. The court deemed this rule non-arbitrary, considering the recruitment's governance under the Rajasthan Police Subordinate Service Rules. The bench highlighted similar provisions for eligibility in panchayat elections, upheld by the Supreme Court earlier.
