UP News: Supreme Court Takes a Stand; Says Muzaffarnagar Student’s Slapping Incident ‘Should Shake State’s Conscience’

The Muzaffarnagar, Uttar Pradesh, event in which a teacher instructed students to slap a classmate drew a harsh response from the Supreme Court, who stated that it "should shake the state's conscience."

UP News: The Supreme Court stated on Monday that a teacher in Muzaffarnagar, Uttar Pradesh, “targeted one community” when she told her students to slap a classmate, and that the state must bear responsibility for the occurrence.

A petition raising concerns over the event in which schoolchildren alternately struck a sobbing Muslim youngster on the teacher’s orders was heard by a bench of Justices Abhay S. Oka and Pankaj Mithal. An FIR was filed against the teacher after the incident’s viral video went viral last month and caused considerable indignation. The bench stated it had “serious objections” about the way the Uttar Pradesh Police handled the case while hearing the appeal on Monday. “The teacher is targeting one community. We will go deep into this. Is this the way teachers teach students – is this quality education? State must take responsibility for this incident… Has the school appointed some counselor for the child? If this incident has happened, then it should shake the conscience of the state. It’s a serious issue,” the bench said.

Supreme Court Condemns Violation of RTE Act in UP School Assault, Orders Immediate Action

It further stated that first, it appeared that the Uttar Pradesh government had disregarded the requirements of the Right to Education (RTE) Act, which forbids the physical and mental harrassment of students as well as their discrimination on the grounds of caste and religion. “There cannot be any quality education if a student is sought to be penalised only on the grounds that he belongs to a particular community,” it said. The court ordered the state government to designate a qualified child counsellor to work with the victim to help him recover from his trauma. It also mandated the appointment of a senior IPS officer to oversee the inquiry and deliver a report to the court in three weeks.

Supreme Court Demands Compliance Report and Counseling for Victim in UP School Assault

“The state will place a compliance report in relation to the victim of the offence. The state shall submit the report on providing better facilities as well as counselling. The court shall then consider whether further directions are needed to ensure there is no violation of RTE Act; moreover, there are detailed guidelines laid down by NCPCR about imposing physician guidelines which shall be placed by the state,” the court order stated.
