Uttarakhand News: Following the Uniform Civil Code (UCC)'s enactment, those who are in or intend to get into live-in partnerships should register under it. Infractions of the regulations may result in a fine of Rs 25,000, a jail sentence of up to six months, or both.
Enthusiastic Reception
"Jai Shri Ram" and "Vande Mataram" shouts were heard earlier today as a measure on the UCC, which would provide uniform laws for marriage, divorce, land, property, and inheritance for all residents regardless of their religion, was introduced in the Uttarakhand legislature. Under the proposed law, minors under the age of 21 must have parental approval and provide a declaration to the Registrar confirming their residency status in Uttarakhand.
Live-In Relationship Regulations
The proposed UCC in Uttarakhand stipulates that anyone who remain in a live-in relationship for longer than a month without filing a statement risk punishment, which may include up to three months in jail, a fine of Rs 10,000, or both. The new UCC stipulates that live-in partners may be imprisoned for up to three months and/or fined up to Rs 25,000 if they falsify information or omit information from their undertaking.
The officer in charge of a nearby police station will receive the live-in partners' comments. If the information in the statement turns out to be inaccurate, the authorities will notify the police station. A woman who has been abandoned in a live-in relationship has the right to petition the court and request maintenance, according to the Uttarakhand UCC. Under the terms of the UCC, a kid in a live-in relationship will be recognised as the couple's legitimate child.
Exceptions to registration of live-in relationships
- If two persons are living together but are involved in a banned relationship, the relationship will not be recorded.
- when at least one of the parties is already married or living together.
- when there is a minimum of one minor among the individuals.
- when one of the partners' permission was acquired through fraud, deception, undue influence, or force.
Termination Procedure
A statement of termination for a live-in relationship must be submitted to the Registrar, whose jurisdiction the residents typically reside, by both partners, or just one of them. A copy of the termination statement should be given to the other partner by the one wishing to stop the live-in relationship.
Fulfilling BJP's Pledge
The UCC bill was introduced earlier today in the state assembly by Chief Minister Pushkar Singh Dhami. Carrying an authentic copy of the Constitution, he entered the legislature in a symbolic gesture. Uttarakhand will be the first state in the nation to embrace the UCC after independence if it becomes an act.
A significant pledge made by the BJP to the state's voters prior to the 2022 Assembly elections, which saw the saffron party sweep to power for a second consecutive term, will be fulfilled by passing legislation on the UCC. Assam and Gujarat, two of the nation's BJP-ruled states, have said how eager they are to adopt the Uttarakhand UCC as a model.
