Uttarakhand's Uniform Civil Code Mandates Approval for Certain Live-In Relationships

According to the UCC Act, there are 74 types of prohibited relationships—37 each for men and women—where individuals cannot marry or enter into a live-in arrangement without official approval. Even with religious consent, the registrar has the authority to reject a registration if it is deemed against public morality or cultural customs.

Definition of Live-In Relationships Under UCC 2024

The law defines a live-in relationship as a "relationship between a man and a woman who cohabit in a shared household through a relationship in the nature of marriage."

A shared household includes any rented or jointly owned accommodation where an adult couple lives together under the same roof. However, the Act mandates that proof of permissibility of marriage must be provided for registration if the couple falls within the degrees of prohibited relationships.

The implementation of these regulations marks a significant shift in governing personal relationships under the new UCC framework. While some view it as an effort to regulate live-in relationships within social and cultural norms, others believe it may introduce legal complexities for consenting adults.
