SC gives permission to UP election panel to hold urban polls with OBC quota

The Supreme Court has given the green signal in the case of urban body elections in UP. After the order of the Supreme Court, now the State Election Commission is ready to issue the notification for the civic elections in UP. A notification can be issued regarding the election within two days. Till now the election was delayed due to the ongoing dispute regarding OBC reservation. But now the Supreme Court has cleared the way for elections.

What did the court say on the civic elections?

During the hearing on Monday, the UP government said in the Supreme Court that we have constituted the OBC commission, the commission has submitted its report. After this, the Supreme Court gave permission to conduct UP body elections with OBC reservation. Apart from this, the court has given permission to issue notification regarding the civic elections. By the way, Solicitor General Tushar Mehta had said that the OBC commission was constituted on 28 December 2022, the commission submitted its report on 7 March 2023.

What was the whole controversy?

In fact, in 760 municipal bodies of UP, there was a plan to hold elections for the mayor of municipal corporation, chairman of municipality-nagar panchayat and councilor seats in December last year itself. The state government had also issued reservation of seats for civic body elections, but the matter regarding reservation went to the High Court. When the High Court ordered for immediate elections without OBC reservation, the UP government reached the Supreme Court against it. On the orders of the Supreme Court, the UP government constituted a five-member OBC commission under the chairmanship of retired judge Ram Autar Singh, which has now submitted its survey report to the government. That report has also been accepted by the court and now civic body elections are going to be held in the state soon.

What will be different in the election?

In this election, 27 percent seats for OBC and 22 percent seats will be reserved for SC-ST. Apart from this, there is a rule of 35 percent reservation for women in civic elections. 35% seats will be reserved for women in each category.
