Uttar Pradesh Government’s New Women-Safety Rules

The Yogi Adityanath government has proposed new rules to guarantee the safety of working women. Women cannot be forced to work between the hours of 7 p.m. and 6 a.m., according to the circular. Yogi Adityanath’s BJP government had previously proposed Rs 75.50 crore for a women empowerment scheme. The state administration has recommended that district-level cyber support desks for women be established.

This rule made by the Yogi Government is applicable to both the government and private sector. The government has stated that if women are engaged in work or duty between 7 pm to 6 am, then the company or organisation must have her consent for the same.

If duty has been imposed on the person, then the organisation faces chances of direct action being taken by the government. Additionally, if a woman refuses to work beyond 7 PM she cannot be fired. A violation of this new rule could lead to a large sum of fines or even jail time for the organisation or company.

It has further asked the factory owners to send a monthly report of female workers engaged in night shift to the inspector of factories of the concerned region.

The government also ordered the employer to take proper steps to ensure no sexual harassment cases against women occur at the workplace.

The new rule is an amendment to the Factories Act, 1948, to protect women employees from incidents of sexual harassment at workplace. It is applicable in both government and private sectors.

“Employer shall take appropriate steps to prevent sexual harassment. The employer shall maintain a complaint mechanism in the factory itself as prescribed in the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 or in any other related enactments,” the order stated.

The new rules come within days of the UP government’s budget for 2022-23 that stressed on better jobs, infrastructure, and health and safety for women in the state.
