Supreme Court rejects Google’s request for Rs. 1337 crore penalties to be stayed

The Competition Commission of India (CCI) fined Google Rs. 1337 crore ($180 million) for suspected anti-competitive activities relating to its Android operating system, but the Supreme Court of India denied Google’s motion for a stay of the payment. The court has given Google one week to deposit Rs. 133.7 crores, or around $18 million, or 10% of the fine.

The National Company Law Appellate Tribunal (NCLAT) has now been ordered by the Supreme Court to rule on Google’s appeal by March 31, 2023. This means that the NCLAT will decide the future of the fine, which is one of the biggest ever issued by the CCI, in the upcoming months.

Competition Commission of India denies allegation that it copied parts of European Order

In a decision against the US company for abusing the dominance of its Android platform on the Indian market, the competition authority on Thursday refuted Google’s claims that the investigators had duplicated portions of a European order.
N Venkataraman, a government lawyer arguing on behalf of the Competition Commission of India (CCI), told the high court, “We have not cuty, cut, and pasted.”

The remarks were made at a hearing in India’s Supreme Court, where Google is attempting to have the CCI decision blocked.

The body fined a $161 million punishment on Alphabet Inc.-owned Google for abusing its dominating position in Android, which runs 97 percent of smartphones in India, and urged it to modify the limitations placed on smartphone manufacturers with regard to pre-installing apps.

Google had contested the order, arguing that it would harm both consumers and its company, and that the expansion of the Android ecosystem would halt if the drastic measures were put into effect.
