Rahul Gandhi Defamation Case: Rahul Gandhi, the head of the Congress, was convicted of criminal defamation on Friday as a result of his remark about the Modi surname. The Gujarat High Court declined to grant a stay on that verdict. The judgement was handed out by Justice Hemant Prachchhak's court.
Gujarat High Court denies postponement, Rahul Gandhi's conviction and prison sentence upheld
Rahul Gandhi suffered a severe loss when the Gujarat high court declined to postpone his conviction and two-year prison sentence in a criminal defamation case, costing him his seat in Parliament. The verdict is announced at 11 a.m. by Justice Hemant Prachchhak, who declined to grant a stay during the previous hearing. Following Rahul Gandhi's conviction in the Purnesh Modi case in Surat, a number of other defamation charges were brought against him. Sushil Kumar Modi, a Rajya Sabha member, filed one of these. The criminal defamation case's proceedings were halted by the Patna High Court on July 4 until January 12, 2023. On July 4, the Jharkhand high court issued a ruling regarding a different defamation lawsuit brought by attorney Pradeep Modi, ordering that no coercive measures against Rahul Gandhi be taken until the next hearing on August 16.
High Court Decision Delivers Major Setback
Now Rahul Gandhi won't be permitted to run for office or request that the suspension of his position as a Member of Parliament (MP) be lifted. The High Court order may be challenged at the Supreme Court. According to the Gujarat High Court, there is no need to interfere with the Trial Court's conviction ruling because it is valid. Consequently, the application is denied. The Court further noted that Rahul Gandhi is the subject of at least 10 active criminal prosecutions. Actually Rahul Gandhi was found guilty in the Modi last name case by a district court in Surat on March 23, 2023. Rahul Gandhi received a two-year prison term.
