Rahul Gandhi defamation case: Gujarat HC refuses interim protection to Rahul Gandhi

Rahul Gandhi defamation case: Rahul Gandhi, the leader of the Congress, requested a stay of conviction in the defamation case involving the “Modi surname,” but the Gujarat High Court on Tuesday turned down his request. The decision regarding Rahul Gandhi’s request for a stay of execution has been reserved by Justice Hemant Prachchhak. The verdict will be released following the Gujarat High Court’s vacatur.

Rahul Gandhi, a leader in the Congress, requested a stay of execution in a criminal defamation case involving his remark about the “Modi surname,” for which a Surat court had sentenced him to two years in prison. The Gujarat High Court was now hearing his appeal. His ineligibility to serve in parliament as a result of the ruling.

The court of Justice Hemant Prachchhak declared that no temporary protection may be given to the the petitioner at this time in the defamation lawsuit resulting from his “Modi surname” statement made four years ago after closing arguments from both parties were finished during the day.

The former Congress president has petitioned the High Court for a stay of conviction, which, if granted, would allow for his restoration as a Parliament Member.

After reviewing the records and proceedings, Justice Prachchhak stated that he would only make a final decision. He then scheduled the case for a decision until the reopening of the High Court following the summer break, which will be from May 8 to June 3.

Gandhi’s lawyer had argued at an earlier hearing on April 29 that a maximum sentence of two years for a bailable, non-cognizable offence meant that he could lose his Lok Sabha seat “permanently and irreversibly,” which would have a “very serious additional irreversible consequence to the person and the constituency he represents.”

Gandhi had stated that his disqualification as a result of not appealing his conviction would have an impact on both him and the residents of his constituency despite the fact that the claimed violation was not significant in character and did not include moral turpitude.
