Supreme Court: Top court rejects PIL seeking an evaluation of Taj Mahal’s ‘real’ history

Supreme Court: The top court rejected to hear a Public Interest litigation (PIL) seeking an assessment of the “true age” and “true history” of the famed Taj Mahal on Monday, stating it is not for courts to judge historical facts about monuments.

Supreme Court’s apathetic response to the petition

“Do not drag courts into everything. Can we determine what is the age of the Taj Mahal or the historical facts behind it after 400 years?” a panel of justices MR Shah and CT Ravikumar asked the counsel representing Haryana-based petitioner Surjit Yadav.

Yadav’s lawyer argued that the petition’s goal was to have schools educate “accurate facts” about the 17th-century monument. He stated that the petition seeks to determine whether the structure existed prior to the construction of the Taj Mahal by Mughal ruler Shah Jahan.

However, the bench seemed underwhelmed. “See your prayers…remove wrong facts? Who will decide what is the correct fact? Will you decide? Is it the job of a court?”
Given the court’s apathy, the lawyer elected to drop the PIL, stating that his client would rather contact the Archaeological Survey of India with the complaint.

Previous request for fact-finding inquiry team to investigate the monument’s history was also rejected

In October, the Supreme Court rejected a similar petition on the Taj Mahal filed by Rajneesh Singh, the media director of the Bharatiya Janata Party’s (BJP) Ayodhya branch. Singh desired that the Taj Mahal’s 22 rooms and chambers be opened. He also requested a fact-finding inquiry team to investigate the monument’s history.

The Supreme Court dismissed Singh’s case on October 21, calling it a “publicity interest lawsuit” and cautioning the BJP leader against bringing petitions in a “casual” way.
