Karkardooma Court frames charges against Tahir Hussain, 5 others in 2020 Delhi riots

Tahir Hussain, a former Aam Aadmi Party member of the council, and five other people were charged on Saturday by a Karkardooma court with violating Section 505 of the Indian Penal Code (IPC) for making “statements conducing to public mischief” during the 2020 riots in north-east Delhi.

Pulastya Pramachala, Additional Sessions Judge observed that Tahir Hussain, Shah Alam, Nazim, Kasim, Riyasat, and Liyakat were acting with a “clear-cut objective in mind” to “kill and harm Hindus”.

“On the record, evidence showed that the accused were instigating others to ‘teach a lesson to Hindus’ and ‘not to leave them. Hence the accused are liable to be tried for an offense under Section 505 of the Code as well,” the order said.

Additionally, the suspects were charged with crimes under IPC Sections 149 and 307 (read with 120B). Tanvir and Gulfam, two further suspects, were cleared of all charges per Section 507.

Hussain is accused in numerous riot-related cases. Ajay Goswami, the complainant in this case, claimed that on February 2, 2020, a mob that was rioting along Karawal Road shot a bullet at him. He had blamed Gulfam and Tanvir for the dismissal.
