Karnataka: School Closed For Three Days, Know Details

With the hijab case turning into a major controversy, the Karnataka High Court on Tuesday said that the international community is watching us and it is not a good development. The High Court, while hearing a petition seeking a ban on hijab in some college campuses, said on Tuesday that it will keep sentiments aside and will run according to the Constitution.

Meanwhile, Karnataka CM Basavaraj Bommai tweeted regarding the controversy that I appeal to all the students, teachers and management of schools and colleges as well as the people of Karnataka to maintain peace and harmony. I have ordered closure of all high schools and colleges for the next three days. Cooperation is requested from all concerned.

Hearing the hijab case, Justice Krishna S. A bench headed by Dikshit said, for me, the Constitution is the Bhagavad Gita. We have to act according to the constitution. I have come to this position after taking the oath of the Constitution. Emotions should be put aside on this issue. Wearing hijab should not become an emotional issue.

During this it was also seen that the government has to answer many questions on this issue. The bench said, “I am getting messages from innumerable numbers. The whole WhatsApp chat is full of this discussion. Institutions can only function according to the Constitution. The government can give orders, but people can question them.

The court also said that the government cannot decide on estimates. The bench said that since the government does not agree with the petitioner’s request to allow students to wear hijab for two months, it will take up the matter on merit. The judge said, “Protests are taking place and students are on the streets, I am monitoring all developments in this regard.”

The bench further said, the government cannot give a verdict against the Quran. Wearing the dress of choice is a fundamental right. Wearing hijab is a fundamental right, however, the government can restrict the fundamental rights. There is no clear order from the government on the uniform. Wearing a hijab is a matter of privacy. The government order in this regard violates the limits of privacy.

The bench also asked whether they would have to exercise at all places. It once questioned the government why they can’t allow hijab for two months and what is the problem? Meanwhile, the counsel for the petitioner submitted that the government can intervene only in those matters which are not fundamental in terms of religion. The government cannot interfere in those things which are fundamental.

The petitioner argued that the government should show leniency in the matter. The matter cannot be decided on the basis of secularism. The government should allow wearing of hijab according to the color of the uniform. Permission has to be taken. Permission has to be given till the end of the examination. After that they can take a decision on the matter.
