Rahul Gandhi: Mohammed Faizal, a Lakshadweep MP, had his conviction in a criminal case set aside today, which ended the political controversy surrounding Rahul Gandhi’s exclusion from office after a Gujarat court gave him a two-year prison sentence. According to sources, Rahul Gandhi may move a sessions court today or tomorrow to overturn his conviction by a court in Surat, Gujarat. During 30 days, he must submit his appeal. Despite being much anticipated, the Election Commission did not reveal the dates for the Wayanad elections today, which are necessary because Rahul Gandhi was disqualified. The Congress said that if elections had been called before Rahul Gandhi’s appeal and ruling on it, the party would have challenged the electoral board.
NCP leader was elected to the Lok Parliament in 2019
Sharad Pawar’s Nationalist Congress Party (NCP) member Mohammed Faizal received a 10-year prison term for trying to kill someone. After his conviction, he was automatically expelled from the House of Representatives. In January, the Kerala High Court suspended the sentence. More than two months after his sentence was suspended, Faisal contested the Lok Sabha secretariat’s “unlawful action” in not revoking his disqualification as an MP. According to Faisal, a fabricated case was filed against him in 2016 over claims that he attempted to kill a cousin of former Union Minister PM Sayeed during the 2009 elections. In the midst of his trial, the NCP leader was elected to the Lok Parliament in 2019.

Kerala High Court suspended Faisal’s sentence two days before the elections
Together with three others, he received a 10-year prison term on January 11. He received a notification of disqualification from the Lok Sabha Secretariat two days later. The Electoral Commission announced on January 18 that Faisal’s Lakshadweep constituency would go to the polls on January 27. The Kerala High Court suspended Faisal’s sentence two days before the elections, obliging the Election Commission to postpone the byelection. Sharad Pawar met with Lok Sabha Speaker Om Birla on January 30 to ask him to overturn the disqualification of his party leader. According to the Representation of the People Act of 1951, a person who has been convicted of a crime and given a sentence of two years or longer is ineligible to run for office.
