SC collegium recommends two judges for promotion to apex court

Supreme Court: The Supreme Court collegium has greenlighted two judges for elevation to the apex court. On Wednesday, the SC Collegium forwarded the names of justices Ujjal Bhuyan and SV Bhatti as the judges of the Supreme Court.

While Bhuyan is the Chief Justice of the Telangana High Court, Bhatti heads the Kerala High Court.

The Collegium comprises the CJI Chandrachud, Justices Sanjay Kishan Kaul, Sanjiv Khanna, Surya Kant and BR Gavai.

Four vacancies coming up

The resolution stated, “After carefully evaluating the merit, integrity and competence of eligible chief justices and senior puisne Judges of the high courts and also accommodating a plurality of considerations, the collegium finds them to be deserving and suitable in all respects for being appointed as judges of the Supreme Court of India.”

Currently, the Supreme Court has three vacancies. After Justice Murari’s retirement on July 8, the number of vacancies will rise to four.

A source familiar with the matter informed Hindustan Times that the Collegium also deliberated upon two other names besides Justices Bhatti and Bhuyan.

The resolution noted, “During his long tenure as a judge of the high court, Mr Justice Bhuyan has acquired significant experience in diverse fields of law. He has acquired a specialisation and domain knowledge in the law of taxation.” It is noteworthy that Justice Bhuyan’s parent high court is Gauhati.

Justice Bhatti represents the Andhra Pradesh High Court.

How are judges selected?

While recommending judges, the Supreme Court considers various factors like their integrity, seniority, merit, regional representation and diversity.

It is learnt that the Collegium also recommended various judges as Chief Justices of High Courts in Bombay, Manipur, Gujarat and Andhra Pradesh.

Under the Memorandum of Procedure (MoP), the Central Government is dutybound to comply with the recommendations of the Collegium. However, no deadline has been set in this regard.
