Shah warns ‘cozy club of dynasts’ after SC ruling on ED chief tenure

Amit Shah, the Union Home Minister, said on Tuesday that the opposition leaders were “delusional for various reasons” because they were “rejoicing” with the Supreme Court ruling over the tenure extensions of Enforcement Directorate (ED) chief Sanjay Kumar Mishra.

Shah emphasised that the Supreme Court upheld the modifications to the Central Vigilance Commission (Amendment) Act, 2021, under which the government can grant the heads of the CBI and ED a maximum tenure of five years.

He said the “powers of the ED to strike at those who are corrupt and on the wrong side of the law remain the same.”

The central probe agency, according to the minister, “rises beyond any one individual and is focused on achieving its core objective” of looking into crimes including money laundering and transgressions of foreign currency legislation.

“Thus, who the ED director is – that is not important because whoever assumes this role will take note of the rampant corruption of a cozy club of entitled dynasts who have an anti-development mindset,” he said in a tweet.

Sanjay Kumar Mishra, a member of the Indian Revenue Service, was granted two extensions of service by the Centre as the head of the Enforcement Directorate, each for a period of one year. The Supreme Court declared these extensions to be “illegal” on Tuesday. A three-judge panel led by Justice BR Gavai concluded that in light of a prior Supreme Court order from 2021, Mishra could not have received the extension past November 2022.

Maximum tenure of 5 years

The Central Vigilance Commission (Amendment) Act, 2021, the Delhi Special Police Establishment (Amendment) Act, 2021, and the Fundamental (Amendment) Rules, 2021—all of which allow the government to grant CBI and ED directors a maximum tenure of five years—were all upheld by the top court.
Opposition applauds the judgement.

Mahua Moitra, MP of the Trinamool Congress and one of the petitioners in the case, hailed the Supreme Court for invalidating Mishra’s extension.

“BJP, we’re going to fight you in the courts as well as the polls. We’ll fight in the streets and the fields, and we’ll never give up, she tweeted.

K C Venugopal, general secretary of the Congress, stated that his party has insisted the ED director’s tenure extension is “totally illegal” from the start.
“The stance of the Congress party has been confirmed. Today, the government has been revealed,” he declared.
