Supreme Court: The group of judges in the Supreme Court known as the collegium has urged that the government to speed up the appointment of judges. They stated that delaying the process of appointing judges disturbs the order of seniority for the candidates.
Supreme Court gets strict on appointments
Recently, the collegium, led by Chief Justice DY Chandrachud, recommended four district judges to be appointed as judges of the Madras High Court. The collegium suggested the names of R Sakthivel, P Dhanabal, Chinnasamy Kumarappan, and K Rajasekar for appointment as judges.
The Collegium’s suggestion comes at a time when disagreements over the nomination of justices have continued between the Supreme Court and the central govt. The Supreme Court maintains that the present collegium system should be maintained, despite the government’s arguments for a new system and modifications to the judge-appointment procedure.
It further stated, “In order to ascertain the fitness and suitability of the above-named judicial officers for elevation to the high court, in terms of the memorandum of procedure, this collegium has consulted the judges of the Supreme Court conversant with the affairs of the Madras High Court.”
SC asks centre to work at earliest
The Supreme Court Collegium noted that not appointing judges in a timely manner or disregarding previously recommended candidates affects the seniority of judges. The collegium instructed the government to act as soon as possible in resolving the issue of pending appointments.
A specific example of the delayed appointment of judges is the case of advocate Saurabh Kirpal, who openly identifies as gay and was recommended as a judge for the Delhi High Court. Saurabh Kirpal is the son of B.N. Kirpal, a former Chief Justice of India.
