Supreme Court Sets Date for Article 370 Repeal Hearing in Jammu and Kashmir

Supreme Court: The hearing of a number of petitions from Jammu and Kashmir contesting the repeal of Article 370 will begin on August 2, according to a statement made on Tuesday by the five-judge Constitutional bench of the Supreme Court. According to reports, the hearing would occur every day.

Supreme Court Sets Date to Review Appeals Against Article 370 Repeal

Beginning on August 2, the Supreme Court will begin considering the collection of appeals challenging the repeal of Article 370, which granted Jammu and Kashmir a distinct status. Today's hearing of the case and consideration of the Center's affidavit in support of the decision were scheduled by the five-judge Constitution bench presided over by Chief Justice DY Chandrachud. The bench set a deadline of July 27 for the submission of documents and written arguments by parties.

Government Highlights Peace and Progress Post Article 370 Repeal

Prior to that, on Monday, the Centre submitted its affidavit to the top court in support of the repeal of Article 370 of the Constitution. According to the Centre's statement to the Supreme Court, the whole Jammu and Kashmir area has experienced a "unprecedented" period of peace, development, and prosperity, with street violence perpetrated by terrorists and secessionist networks becoming "a thing of the past." The Union administration said that organised stone-pelting incidents linked to terrorism-separatist agenda, which peaked at 1,767 in 2018, have decreased to zero as of today in 2023, and that the number of security personnel casualties has decreased by 65.9% from 2018 to 2022.

Centre's Affidavit Highlights Prosperity and Stability Post Article 370 Repeal

It argued that the "historic constitutional step" that is being contested has provided the region unheard-of prosperity, progress, security, and stability, which were frequently absent under the previous Article 370 regime. According to the affidavit, the Union of India's goal of promoting peace, prosperity, and progress in the area has made it possible for the same to occur. “It is submitted that the hosting of G-20 Tourism Working Group meeting at Srinagar in the month of May 2023, was a watershed event in the history of valley tourism and the country proudly displayed its resolute commitment to the world that secessionist terrorist region can be converted into a region where even international dignitaries can be invited and global events can be held." The Jammu and Kashmir and Ladakh UTs have undergone profound "ameliorative, affirmative and progressive changes in the last four years encompassing its entire governance - including the developmental activities, public administration, and security matters which has positively impacted every resident irrespective of caste, creed, or religion," according to the Centre, following the historic changes.
