Delhi High Court’s Green Resolution; Quashes Assault FIRs, Orders THIS Instead

The Delhi High Court has ordered the members of two families to plant 400 saplings in respective neighbourhoods in order to stop their “negative energy” by giving back to society. The families were embroiled in a brawl over a minor problem that was later resolved. According to the court, the parties must plant the saplings and care for them for five years.

Plant 200 Trees Each to End Negative Energy from Criminal Cases

The court halted the procedures in two criminal cases that were filed for the alleged crimes of criminal intimidation, culpable homicide attempt, house trespass after preparation for injury, assault, or wrongful restraint. “However, I consider that the negative energy of the parties should be put to an end by directing them to contribute to the society. Hence, the petitioners in both cases are directed to plant 200 trees each in their areas. The place shall be identified by the investigating officer (IO) after consultation with the horticulture department and he shall inform the petitioners 15 days in advance,” Justice Dinesh Kumar Sharma said. The court ordered the IO to investigate the potential of geotagging the seedlings so that they can be properly monitored by the relevant authority. In November, it has requested a compliance report on the subject. The complainant claimed in the first FIR that the incident occurred on March 4, 2017, when three family members visited his home and requested their IDs in order to obtain blankets that were to be donated by a political party candidate.

Parties Reach Settlement after Verbal Argument Turned Physical

The three, however, were informed by the complainant that they were members of another political party, which sparked a verbal argument that turned physical. In the second FIR, the opposing side claimed that the other family got into a fight with them and beat them up while they were gathering IDs in order to distribute blankets. In January, both parties reached a settlement and informed the court that they had done so voluntarily, without the use of intimidation, compulsion, or fear.
