Imagine filing the right form on time, only to find your name missing from the voter list. For a family of six in Goa, that is what happened, and now the Bombay High Court wants answers from the Election Commission of India (ECI).
What Happened in Goa?
The family submitted Form 8 to update their address after moving within the same constituency, but their names were removed during the SIR enumeration process. This is Santa Cruz constituency, during the Special Intensive Revision (SIR) of voter rolls. The ECI said its software did not allow Form 8 to be processed during the enumeration phase, and the family was asked to fill Form 6 instead.
Why Form 6 Was Not the Answer
Form 6 is meant for new voters. This family were existing voters. The bench put it plainly: they were never new voters, but they became “new” for the ECI‘s system. The court also stressed that the poll body cannot force voters to fill Form 6.

“Software Cannot Overwrite the Law”
The court was not impressed by the software explanation. The judges asked why a process that worked before electronic systems could not be handled once the software failed to accommodate it. The Goa bench held that administrative software systems cannot supersede statutory laws, and that the draft roll cannot be the basis for deleting names.
Deletion Without a Hearing?
A key concern is fairness. The bench questioned the ECI on which legal provisions allow it to delete names without a hearing. The petitioners said the ERONET system offered only a “reject” option and no way to review or restore deleted records. The judges also wondered aloud how many other affected voters have not come to court.

- Check your name on the official voter portal or the Voter Helpline app.
- Keep proof of every form you submit, including receipts and acknowledgements.
- Follow up in writing with your Electoral Registration Officer if a name goes missing.
- Apply on time if you need to be added or corrected.
