SC directs MP govt to re-examine 75 percent reservation for state residents in B.Ed admission

The Madhya Pradesh government has received a setback from the Supreme Court on the policy made in the Bachelor of Education (B.Ed) course. The double bench of Justice Dinesh Maheshwari and Justice Sudhanshu Dhulia has directed to examine the policy of giving 75 percent reservation to the residents of Madhya Pradesh state for admission in B.Ed course. The bench termed this policy as ‘overdose of reservation’ and unconstitutional.

The Court delivered its verdict on a PIL filed by Veena Vadini Samaj Kalyan Vikas Samiti and remarked that the data for the last two years indicates that it does not serve the intended purpose. The Madhya Pradesh High Court had given a verdict supporting this reservation policy of the government, which was challenged in the Supreme Court.

‘Ground reality should have been taken care of’

However, the bench has also said that the state has done the reservation of seats for the residents within its rights, but while doing so it should have kept in mind the ground reality. Therefore, from the next academic session, the number of seats for the local residents of the state and the rest of the countrymen should be determined again.

‘Giving 75 percent reservation is unfair’

The court also clarified that reservation is allowed for local residents. Still, reservation up to three-fourth of the total seats that is 75 percent is unfair. The Supreme Court has already called it unconstitutional and violative of Article 14 (equality before law) of the Constitution in the case of Pradeep Jain vs. Government.

Excessive reservation does not serve any purpose

The court has asked the state government to do a comparative study of the figures of the last few years related to this subject so that it can be known to what extent such reservation should be there. The bench said that we have seen that apart from defeating the purpose of reservation, excessive reservation does not serve any purpose. The authorities will have to keep this in mind while taking a decision in this regard.
