Gyanvapi Masjid: SC extends protection of ‘Shivling’ in Varanasi till further orders

Three cases related to Gyanvapi Masjid of Varanasi are to be heard in the court today. In which the hearing in the Avimukteshwaranand case has been postponed.

Shankaracharya was a disciple of Swami Swaroopanand Saraswati and now after his death, Swami Avimukteshwaranand and Ramsjivan, who are holding the post of Shankaracharya, have filed a suit in the court through senior advocate Arun Kumar Tripathi, Ramesh Upadhyay Chandrashekhar Seth, in which the civil judge in the Shringar Gauri case ( Senior Division), the shape of Shivling found in the court commission proceedings should have been duly done by the district administration for Ragbhog, worship and aarti. But till now the administration has not done so.

Neither did any other person associated with Sanatani religion have been appointed for this. He told that the status of the deity is like a living child by law. To whom not giving food and water is a violation of the fundamental right to personal liberty under Article 21 of the Constitution.

On the other hand, objection has been sought from the opposition in the case of Gyanvapi survey given by the plaintiff Mukhtar in the case filed on behalf of Mukhtar Ahmed and the date of hearing has been fixed on 8th December. The matter is pending in the court of Civil Judge, Fast Track Court, Senior Division Mahendra Pandey, in which a demand has been made to hold the entry of Hindus.

A hearing was held in the Allahabad High Court today on the matter of conducting the survey of the Gyanvapi complex by the Archaeological Survey of India. In which the court has given the next date of November 28.

Hearing of Gyanvapi-Maa Shringar Gauri case


The hearing of the Gyanvapi-Maa Shringar Gauri case was held on November 2 in the court of Varanasi District Judge Dr. Ajay Krishna Vishwesh. During this, a hearing was held on the demand to proceed with the commission’s proceedings by demolishing the basement and removing the debris in the Gyanvapi campus. An objection was filed in the matter on behalf of the Muslim side, Anjuman Inazaniya Masajid Committee. The court had fixed November 11, today as the date for filing counter objection on behalf of the Hindu side.

Hindu side’s advocate Vishnu Shankar Jain said that the plaintiff has told the court to proceed with the commission proceedings under 82C. On that, the respondent Anjuman Arrangement Committee has filed its objection in the court. On which the court had fixed the date of November 11 for the plaintiffs to present their side.

Right to worship the alleged Shivling

Hearing will be held today on the application filed by Shankaracharya Swami Avimukteshwaranand Saraswati regarding worship, recitation, raga bhog, aarti of the figure of Shivling found in the Gyanvapi complex. They say that legally the condition of the deity is like a living child, to whom not giving food and water is a violation of the fundamental right to personal liberty under Article 21 of the Constitution. In such a situation, worship should be allowed.

The Supreme Court will hear on Friday the application for protection of the ‘Shivling’ found in the Gyanvapi Masjid complex in Varanasi. A bench will also be constituted to consider the matter. The Supreme Court will hear a petition seeking extension of the deadline for preserving the Shivling found in the Gyanvapi complex from November 12.

Advocate Vishnu Shankar Jain, appearing for the Hindu side, mentioned the matter before a bench headed by Chief Justice Justice DY Chandrachud on Thursday and sought early hearing of the petition. The Supreme Court has fixed the hearing on the matter of protection of Shivling at 3 pm today. In a previous order, the Supreme Court had directed the District Magistrate of Varanasi to ensure that the place where the ‘Shivling’ was found inside the mosque is kept safe.
