Uttar Pradesh Court Finds One Guilty, Clears Three in Hathras Rape-Murder Case Due to Lack of Evidence

Uttar Pradesh: In the Hathras rape-murder case, an Uttar Pradesh court on Thursday found one person guilty while clearing three others. According to Section 304 of the Indian Penal Code, the court found the primary accused guilty of culpable homicide that did not constitute murder. Here is the rationale behind the Hathras case’s dismissal of the rape charge.

Guilty verdict in Hathras rape-murder case

According to the court, the victim and her mother did not tell the doctors about the sexual assault when she was admitted to the hospital on September 14, 2020. A week after the victim was admitted to the hospital, on September 22, the first mention of a sexual assault was made.

Victim’s inconsistent statements and delayed reporting

No evidence of sexual assault was found in the victim’s samples after medical testing. The victim’s neck bore a ligature mark, which the court determined was consistent with an attempt to strangle the woman, but it was not the cause of her demise. Injuries to the victim’s body were caused by a single attacker, according to the court, and did not signify an attack by several attackers.

Identity of other defendants revealed later on

According to medical evidence and the court order, indirect blunt trauma causes injury to the cervical spine (neck), along with any sequelae that may follow. The victim’s statements were deemed “inconsistent” by the court because there were contradictions between what she told the female constable and the doctors. The victim spoke to the media and recorded videos on September 14 but failed to mention any sexual assault, according to the court. The victim kept the identities of the other defendants a secret until she gave police statements on September 22, according to the court’s further ruling.
