Kerala HC: It’s important to understand that constant Comparisons not only hurt an individual but also affect mental health to a great extent. So after taking a close look at this problem, the Kerala High Court has come out with a judgement which states that if a Husband compares his wife to other women and repeatedly taunts her about her look, then that amounts to cruelty and can be considered grounds for divorce.
The court came up with this judgment, after dissolving the marriage of a couple who had filed for divorce 13 years ago on the ground of cruelty.
The entire matter
Well, an application was filed in the Kerala High Court by woman who said, that all this started in the year 2009 when her husband constantly used to comment on her physical appearance.
The man used to comment that she is not as beautiful as other women and she felt led down after hearing those statements. The two lived together for barely 1 month after their marriage. The Kerala High Court in its judgment held that repeated remarks on the wife are not correct and are grounds for divorce.
The bench further said that , “The constant and repeated taunts of the respondent/husband that the petitioner is not a wife of his expectations and the comparisons with other women etc. would certainly be mental cruelty which a wife cannot be expected to put up with.” Hearing this application, the court approved the divorce of both. In fact, the woman’s husband had challenged the family court’s decision of divorce between the two in the High Court 13 years ago.
While it’s important to understand that married woman has the right to live with dignity. And she does deserve the same amount of Respect as that if her husband. While The right to live with dignity means to be free from mental or physical torture. And If this is not happening, then he will come under the ambit of domestic violence.
