Azam Khan Remains Disqualified As MLA

On Thursday, the MP-MLA (Session Trial) court rejected Azam Khan’s application for a stay on the lower court’s decision in the hate speech case. Along with this, the court has ordered the prosecution to file an objection on Azam Khan’s appeal on Friday. The next hearing on Azam Khan’s appeal will be held on Friday.

SP leader Azam Khan was convicted on October 27 by the MP-MLA (Magistrate’s Trial) Court of Rampur for making hate speech and sentenced to three years imprisonment and to pay a fine of Rs. His legislature was canceled the next day on October 28, after being sentenced to three years by the court and Rampur assembly seat was declared vacant. After this, the Election Commission had announced to hold a by-election on Rampur assembly on November 05.

The gazette notification for the by-election was to be issued on November 10. The filing of nomination papers for the by-election was also to begin from November 10. Meanwhile, SP leader Azam Khan had filed a petition in the Supreme Court on 7 November. In which he raised questions on the intention of the government and the process of elections. On which hearing was held in the Supreme Court on Wednesday in a bench headed by Chief Justice DY Chandrachud. On Wednesday itself, Azam Khan appealed against the lower court’s decision in the sessions court.

The Supreme Court has said in its decision that the appeal filed by Azam Khan in the Sessions Court against the sentence of the lower court should be heard after hearing the stay application on Thursday (November 10). After the order of the Supreme Court, on Thursday, special judge Special Judge MP-MLA (Session Trial) Alok Dubey’s stay application was heard in the court. After hearing the arguments of both the sides, the court rejected the stay application of SP leader Azam Khan. The court has said in its order that the prosecution should file an objection on Azam Khan’s appeal on Friday.

The court has rejected our stay application. We have not received the copy of the order yet. Any further step will be taken only after studying the copy of the order.
