Gujarat BJP MLA Purnesh Modi moves Supreme Court in defamation case against Rahul Gandhi, details

BJP MLA Purnesh Modi files caveat in Supreme Court.

Gujarat High Court: Purnesh Modi who sued Rahul Gandhi over his remark “how come all thieves have Modi as the common surname?”, has filed a a caveat in the Supreme Court. Gujarat High Cour’s convicted Rahul Gandhi after which his Parliamentary Membership was suspended as Member of Parliament for Wayanad.

The development comes after Gujarat High Court dismissed a petition from Rahul Gandhi for holding his conviction in a criminal defamation over his remark. The court had said that the conviction was “just, proper and legal. After this it was announced that Rahul Gandhi would go to Supreme Court for justice.

Caveat filed

As per the reports, the caveat was filed by Purnesh Modi on July 7, the same day Rahul Gandhi’s petition was dismissed by the Gujarat High Court. In the application it is stated by Modi that if the verdict comes against Rahul Gandhi in Gujarat High Court and Rahul Gandhi decides to file a petition in Supreme Court then no order should be pronounced from the apex court before hearing arguments from both sides. Congress has already decided to challenge the decision of Gujarat High Court in the Supreme Court.

Defamation against Rahul Gandhi

The case of defamation was filed over a remark made by Rahul Gandhi in 2019  during an election rally at Kolar in Karnataka where he asked the question that how come all the thives have ‘Modi’ surname in common. The jibe was made to target Prime Minister Narendra Modi but as Modi surname had been insulted Purnesh Modi filed a case against Rahul Gandhi. A metropolitan magistrate’s court in Surat convicted Rahul Gandhi for two years imprisonment under Indian Penal Code (IPC) sections 499 and 500 (criminal defamation).
