CJI NV Ramana Recommends Justice UU Lalit As His Successor

CJI N.V. Ramana on Thursday, August 4, 2022 recommended to the government the name of Justice Uday Umesh Lalit as his successor and the 49th Chief Justice of India.

Raman’s tenure will end on August 26, became the 48th Chief Justice of the country on 24 April 2021, succeeding SA Bobde.

On Wednesday, the Ministry of Law and Justice consulted Raman on who they would like to choose as their successor following which Justice Uday Umesh Lalit’s name was put forward according to seniority.

HOW IS THE CJI APPOINTED?

As per the Memorandum of Procedure (MoP), which governs the process of appointment of judges in the higher judiciary, the outgoing CJI initiates the process of naming the successor after getting communication from the Law Ministry.

The CJI, as is customary, recommends the most senior Supreme Court justice as his successor. The Law Minister then forwards the CJI’s recommendation to the Prime Minister, who advises the President on such appointments.

However, it was not followed twice: Once when Justice AN Ray was appointed CJI on April 25, 1973, superseding three senior-most judges, and again on January 29, 1977, when Justice MH Beg was appointed CJI, superseding Justice HR Khanna.

Justice Lalit, born on November 9, 1957, was enrolled as an advocate in June 1983 and practised in the Bombay High Court till December 1985.

He later shifted base to Delhi. Justice Lalit was then designated senior lawyer by the Supreme Court in April, 2004.

Justice Lalit was part of several landmark judgements of the apex court.

One of the path-breaking verdicts was the August 2017 judgement by a five-judge constitution bench which by a 3-2 majority ruled the practice of divorce through instant ‘triple talaq’ as “void”, “illegal” and “unconstitutional”.
