H1B Visas: Massive Cap Cutdown, Exemptions Eliminated! Why Has America Suddenly Started Deserting India?

H1B Visas: At the first glance, it may appear that India is being directly targeted by the proposed legislation. However, the legislation is about anti-dependence on foreign skilled labour. So while India is not uniquely targeted, it is uniquely exposed.

H1B Visas: The United States is all set to decide on the “End H-1B Visa Abuse Act of 2026” that was introduced by Eli Crane and supported by several Republican lawmakers, including Brandon Gill, Paul Gosar and Andy Ogles.

The legislation involves a pause to the issuance of H-1B visas for a period of 3 years.

H1B Visas-What’s Special?

Crane remarked that the US Federal Government should not work for the profit margins of large corporations but for hardworking citizens of America. Crane further remarked that we owe this to the American people.

Crane also commented that the bill would offer greater access to employment, prioritize the livelihoods of Americans and strengthen visa process protocols.

The New Bill: A Hard Reset, Not Just Reform

The legislation proposes potential elimination of the H-4 visa program, affecting dependents, replacement of the lottery system with a wage-based selection model and a broader push to restrict foreign labour entry into the US workforce.

It is argued by the supporters of the legislation that the pause would help policymakers “rebuild’ the system from scratch. On the contrary, critics warn that the bill could disrupt industries reliant on global talent and derail thousands of careers.

Is India Being Singled Out?

The Economic Contradiction

The legislation’s biggest contradiction is that America needs talent, but fears it at the same time. For decades, the H-1B program has powered innovation in Silicon Valley and beyond.

Studies have linked skilled immigration to higher productivity, innovation and economic growth. However, the same program is somehow accused of depressing wages in certain sectors, allowing companies to bypass domestic hiring and encouraging outsourcing models.
