‘Misguided and Controversial,’ Kapil Sibal Condemns Amit Shah’s Remarks on SC

Kapil Sibal: Home Minister Amit Shah made a strong statement following the Supreme Court’s decision to grant Delhi Chief Minister Arvind Kejriwal interim bail so he could campaign for the Lok Sabha elections. He emphasized that many people in the nation feel that “special treatment” was granted.

Amit Shah Criticizes Kejriwal’s Claims

Shah was questioned on Wednesday about the AAP chief’s assertions that he wouldn’t have to return to prison if the party received a sufficient number of votes during an interview with news agency ANI. Amit Shah said, “I believe this is clear contempt of the Supreme Court. He is trying to say that if someone emerges victorious, the Supreme Court does not send them to jail even if they are guilty. The judges that granted him bail have to think how their judgment is being used or misused.”

Shah responded, “The Supreme Court has the right to interpret the law,” to a question about his thoughts on the ruling. He added, “This, in my opinion, was not an ordinary or customary decision. Many in the country believe that special treatment has been given.”

Sibal Criticizes Shah’s Controversial Statement

Rajya Sabha MP and Senior Advocate Kapil Sibal says, “The first thing that Amit Shah has said today, I think it is a very controversial statement. He has targeted the Supreme Court’s will. He has said that many people say that Kejriwal has received the last bail. This is a special treatment of the judiciary. It has been done especially for him. This is what it means. It means that you have targeted the will of the judges of the Supreme Court.”

“He never gives this statement if he does not believe what the people are saying. He does not believe what the people are saying. Because he has said very cleverly that the people are saying. So if the people are saying and you do not believe, then you should not give such a statement. And if the people are saying and you believe, that is why you have given such a statement. So do not hide behind the veil of what the people are saying. This is such a controversial statement, which I think should not be given to a Home Minister of this country. A Home Minister who does not know much about the laws. So let me explain a little through you.,” he added.

Clarification on Conviction and Election Rights

Sibal further said, “The first thing is that if someone is convicted. If someone is convicted and gets punished for more than 3 years or more than 2 years. So if he gets a stay of punishment from the court. Then he can also submit his nomination letter. He can also do the nomination paper and can also be elected. Means a convicted person also can get elected. Okay? And if there is a charge sheet against someone. Then he can also do publicity.”

He added, “If there is a charge sheet and there is no charge frame. But he can also do publicity and can also file a nomination paper. Like Mr. Brij Mooshan. Mr. Brij Mooshan is charge sheeted. So how is he doing publicity for his son? In which area is he doing it? On which law is he doing it? This is the law. So one who is punished. He can also file a nomination paper and can also be elected. One who is charge sheeted He can do publicity, file a nomination paper and can also be elected.”

He further said, ” And if there is a charge sheet against someone. He can also do publicity. This is a strange statement and a strange thing. If there is a charge sheet against someone. Sibal added, “Why he is worried about this Rajya Sabha MP Swati Maliwal assault case. It’s an internal matter of AAP. You think about Prajwal, why don’t you give statements on that. That is the internal matter of JD(S)…”
